A 21-year-old man has made his first appearance in court for the alleged rape of a 49-year-old woman who had had a child by his uncle.
He is under preliminary investigations at the magistrates’ court No. 2 presided over by KombaKamanda on one count of sexual penetration contrary to section 6 of the Sexual Offences Act No. 12 of 2012.
The victim, a mother of six who introduced herself as a petty trader, testified as first prosecution witness. She said she always took sleeping pills to get a good night rest because of the “tiresome” nature of her business.
On the night of June 13, 2013, she said, she woke up to the sound of her daughter who “wanted me to see something”. She testified that when she woke up, she saw the accused naked on top of her and herself half naked. “His manhood was inside me and I saw semen on my private part”.
“My children were very angry as that was the third time he was doing that to me”. Living in the same residence, she went on, she hada child by the late uncle of the accused.
First prosecution witness confessed that she didn’t want the matter in court as relatives had pleaded with her to treat it “out of court”. She said that she reported to the police because the accused refused to “behave himself”.
The matter was adjourned to tomorrow Wednesday July 24.
